1. Introduction
This document constitutes the Terms of Service ("ToS") for Moonlit Platform, a service offering a no-code environment for the development and sharing of custom AI applications. By accessing or using Moonlit Platform, users agree to these terms.
2. User Registration and Eligibility
The platform is available to business entities without specific eligibility criteria, subject to prevailing legal regulations. Access to the services provided by Moonlit Platform requires registration, involving the provision of a user’s name, email address, and photo URL (if utilizing a third-party authentication service like Google).3. Usage Policy
Users are prohibited from exploiting the service, including but not limited to creating multiple accounts for the purpose of accruing additional service credits. Engaging in destructive or disruptive behavior, including Distributed Denial of Service (DDoS) attacks, is strictly forbidden. New users will receive an initial grant of 1000 credits, subject to guidelines governing acceptable use.
4. Payment and Billing
Moonlit Platform operates on a subscription-based model, facilitated through Stripe. Users may cancel their subscription at any point; however, the service will revert to a free plan following the conclusion of the current billing cycle. Subscription fees are non-refundable, except in instances of overcharging due to an error by Moonlit Platform.
5. Intellectual Property and User Data
All data uploaded to Moonlit Platform is the property of the platform, though users maintain rights and control over their respective data. Users reserve the right to request the deletion of their data at any time. Notably, users have the capability to create and secure their AI applications, and with user consent, selected applications may be featured on Moonlit Platform's templates page.
6. Data Protection and Privacy
Moonlit Platform is committed to the security of user data. Data storage is managed via Firebase's Firestore, supplemented with robust security protocols. Additionally, data is backed up hourly to Google Storage, ensuring encryption and safety.
7. Liability and DisclaimersLiability:
Moonlit Platform provides its service on an "as is" and "as available" basis without any warranties of any kind, including the warranty of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.Neither Moonlit Platform nor any of its affiliates, directors, employees, or agents will be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use or inability to use our services, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses.Disclaimers:

8. Termination of Service
Moonlit Platform reserves the right to terminate user accounts and delete associated data at any time without prior notice.
9. Dispute Resolution
Any disputes arising out of or in connection with these Terms of Service shall first be attempted to be resolved through amicable negotiations between the parties. If a dispute cannot be resolved through negotiation, the parties agree to submit the dispute to binding arbitration. The arbitration will be conducted in Lisbon, Portugal, in accordance with the Portuguese law. The decision of the arbitrator will be final and binding on both parties. Notwithstanding the above, Moonlit Platform may seek injunctive or other equitable relief in any court of competent jurisdiction.

Users will be notified of any amendments to these ToS via email and updates on the Moonlit Platform website.
